Estates usually mean it is a difficult time. A loved one has passed away. The question is what do you do now? As far as legal matters go there is no rush. Take care of your loved one and the funeral arrangements. The funeral home will provide several copies of the death certificate and the CPP application forms.
After the funeral will be time enough to arrange to see a lawyer. In the meantime try to assemble documents. The Last Will, Deed to the house, bank accounts, investment statements, Life Insurance and last income tax return. At your very first meeting with Mr. King he will be able to tell you how to proceed to deal with the Estate. The first question will be do you need to probate the Will? If there is no need to Probate then there are no fees to be paid to the government. This is a money saver and Mr. King can advise you up front. If probate is necessary Mr. King will explain the process and guide you through it. If there are distributions to be made under the Will then accounts have to be kept and you will be shown how this is done.   If you don't have all of the asset valuations our friendly staff are here to do it for you. The set of accounts for all the beneficiaries have to be prepared in legal format and Mr. King has lots of experience in doing them for executors. Following final accounting we will assist you with final releases from the beneficiaries and with the distribution of funds.
Then there is the tougher side of Estates. Controversies over the contents of the Will. Whether you are contesting the Will or defending the Will Mr. King can guide you through the law of Mental Capacity (did the testator have the mental capacity to understand what they were signing) and Undue Influence (whether the deceased was influenced by someone close to the testator to the detriment of other heirs). Whatever your position is, pro or con, you need Mr. King to advise you and fight for you whether by mediation or in court. Make an appointment with our office as soon as possible especially to avoid missing time limits for filing Notices of Objection.
